El anterior 2 de diciembre de 2019, la sala I del Tribunal de Sentencia con jurisdicción nacional en Materia Penal de la ciudad de Tegucigalpa emitió sentencia en contra de siete autores materiales por el asesinato de Berta Cáceres, lideresa indígena y co-fundadora del Consejo Cívico de Organizaciones Populares e Indígenas de Honduras (COPINH) y la tentativa de asesinato contra Gustavo Castro, hechos ocurridos el 2 de marzo de 2016.
Entre los sentenciados se encuentran trabajadores de la empresa Desarrollos Energéticos S.A. (DESA) y miembros de las Fuerzas Armadas de Honduras.
El Tribunal, que dictó su sentencia a más de un año de haber finalizado el juicio oral, confirmó que la acción de resistencia del pueblo lenca organizado en el COPINH y liderado por Berta Cáceres en defensa del río Gualcarque “ (…) ocasionó que se planificara y mediara la forma de dar muerte a la señora Cáceres, todo ello con el conocimiento y consentimiento de los ejecutivos de la empresa DESA, entre ellos el señor Sergio Rodríguez y otros más que no son parte de este proceso.”
Lo anterior reafirma que el asesinato de Berta Cáceres fue una acción planificada y organizada con el conocimiento y consentimiento de los ejecutivos de la empresa DESA, con el propósito de neutralizar la resistencia del pueblo lenca.
En virtud de lo señalado, organizaciones nacionales e internacionales de derechos humanos, hemos observado con detalle la búsqueda de justicia por este crimen y las violaciones en torno a esta causa. Reconocemos que se dicten condenas en contra de responsables materiales, sin embargo, se mantiene nuestra preocupación acerca de la falta de acción contra la totalidad de los autores intelectuales.
De esa manera, exigimos al Estado de Honduras, que avance en el procesamiento de David Castillo, cuya audiencia preliminar se ha suspendido durante tres ocasiones por acción de su defensa Igualmente, solicitamos que se avance a la mayor brevedad en la gestión de diligencias investigativas y judiciales en contra de los demás autores intelectuales vinculados al crimen y que actualmente permanecen en la impunidad.
El Estado de Honduras debe actuar con diligencia contra los autores intelectuales como ha promocionado su actuación contra los autores materiales.
Asimismo, exhortamos al Estado de Honduras a que se revoque la concesión sobre el río Gualcarque, sagrado para la cosmovisión lenca, que órganos como la Comisión Interamericana de Derechos Humanos (CIDH) han identificado como la principal fuente de riesgo para la vida e integridad del pueblo lenca y las comunidades del COPINH.

In light of the conviction and sentencing of seven people for the assassination of Berta Cáceres: Human rights organizations demand that progress be made in the investigation, trial and punishment of the intellectual authors.

On December 2nd, 2019, the First Chamber of the Sentencing Court with national jurisdiction in Criminal Matters, based in the city of Tegucigalpa, issued sentences against seven perpetrators for the assassination of Berta Cáceres, an indigenous leader and co-founder of the Civic Council of Popular and Indigenous Organizations of Honduras (COPINH), and the attempted assassination of Gustavo Castro, which occurred on March 2nd, 2016.
Among those sentenced are workers of the company Desarrollos Energéticos S.A. (DESA) and members of the Honduran Armed Forces.
The Court, which handed down the sentences more than a year after the oral trial finished, confirmed that the resistance and organizing efforts of the Lenca people under the auspicies of COPINH and led by Berta Cáceres in defense of the Gualcarque River «(…) caused the planning of the assassination and hiring of assassins to kill Mrs. Cáceres, all with the knowledge and consent of the executives of DESA, including Mr. Sergio Rodríguez and others who are not part of this process.”
This reaffirms that the assassination of Berta Cáceres was a planned and organized action with the knowledge and consent of the executives of the company DESA, with the goal of neutralizing the resistance of the Lenca people.
National and international human rights organizations, including COPINH, have observed in detail the search for justice for this crime and the violations surrounding this cause. We recognize that convictions have been handed down against the material authors, but we remain concerned about the lack of action against all the intellectual authors.
In this regard, we demand that the State of Honduras advance the prosecution of David Castillo, whose preliminary hearing has been suspended on three occasions by his legal defense. Likewise, we demand that progress be made as soon as possible in the investigative inquiry and judicial proceedings against the other intellectual authors linked to the crime, who currently remain unpunished.
The State of Honduras must act diligently against intellectual authors as it has promoted its action against material authors.
We also urge the State of Honduras to revoke the concession of the sacred Gualcarque River, sacred to the Lenca world view. Bodies such as the Inter-American Commission on Human Rights (IACHR) have identified as the concession as the main source of risk to the life and integrity of the Lenca people and the COPINH communities.
